Last September, after a long delay, the BBMP had invited new tenders for garbage collection and transportation in 91 packages. The 198 wards of the city are covered by these 91 packages. But the new tenders have come to effect in not even half of these; only 43 packages have new contractors now. In the remaining 48 packages, work is still being done by old contractors by extending their previous contracts.
But a bunch of new tenders – 12 of them – were approved by the state government on March 20, 2013. The government’s approval came on the day when the code of conduct for elections was announced. No new works can be started when the code of conduct is in place, and hence the BBMP has not been able to issue work orders to for the 12 packages.
Interestingly, for half of these packages, the bid amount is below 75% of BBMP’s original estimate. In one case, the quote is only about 53% of what the BBMP had estimated. Though these bids cost less, the question is whether the bidders can perform well with low investments, or whether it is the BBMP’s estimate that is inflated.
B T Mohankrishna, Technical Advisor to the BBMP Commissioner, says that they have written to the Chief Electoral Officer (CEO), Karnataka, asking for permission to issue work orders. Another 36 packages that do not have new contractors are also going to be retendered. For this too, the BBMP has asked the CEO’s permission.

BVG to be barred from tender process
Of the 36 packages to be re-tendered now, 33 are that of Bharat Vikas Group India Private Ltd, the company that won the highest number of packages last year. The BBMP says that it will forfeit the entire EMD (Earnest Money Deposit) of BVG India. While the BBMP accused BVG of non-performance, BVG has said that BBMP officers were preventing them from starting work, to favour old contractors. This resulted in a court case that challenged the new tenders. In mid-January, BVG had submitted an affidavit in court saying that it was ready to withdraw from the tenders if the BBMP returns half of its EMD.
There has been no order from the court on this yet, and the BBMP has decided to forfeit the entire EMD and go ahead with the new tenders. BVG will be barred from participating in the new tenders.

‘No court order on stopping tenders’
Another package to be re-tendered is one which covers Madivala and BTM wards (172 and 176). The BBMP
says that contractor Ayyappa Varaprasad had not initiated works.
The other two packages to be re-tendered, had been stuck in court previously. These tenders cover five wards – Hosakerehalli (161), Ganesh Mandira (165), Yadiyur (167), Chikkakallasandra (183) and Yalachenahalli (185) When the BBMP had invited tenders initially, in December 2011, only a few packages got response.
Because of this, the BBMP had not sent these tenders for government’s approval. Instead, the BBMP had changed the terms of the tender, and floated them again in September 2012. Following this, two contractors who had won the packages in December 2011, went to court. Hence, the BBMP had avoided calling tenders for these two packages in September 2012.
“There is no interim order from the court to prevent the BBMP from calling tenders. So these two tenders are also being floated now,” says Mohankrishna.⊕
