In a boost to the Right To Information (RTI) movement in the country, the Punjab and Haryana High Court, in February this year, upheld the levy of penalty by the Haryana State Information Commission, on the State Public Information Officer (SPIO) for delay in furnishing information to an RTI applicant. Recently, on 1st July 2008, the High Court of Karnataka declared that personal information of the public authorities cannot be made available through the Right To Inforamtion Act, 2005. The order was a result of a writ petition filed by H E Rajashekarappa, Joint Director (Statistics) at Animal Husbandry and Veterinary Services Department, at Ambedkar Veedhi, Bangalore. Come rains and most roads of the city are flooded. Some roads see potholes and muddy water all over, some lose their asphalt cover and some others are deformed. You may be surprised to know that the BBMP appoints private consultants to repair flood damage on roads with its own engineers. A key right-to-information question was resolved when the Karanataka High Court on 30 June 2008, declared that registered Co-operative Societies are not public authorities under the RTI Act, 2005. The Government of Karnataka under Governor Rameshwar Thakur's administration has added a new rule, #14, which places a restriction on the subjects and the number of words to be contained in an application asking for information under the RTI Act. On 14 May, the Karnataka Information Commission (KIC) ruled that the Bangalore International Airport Limited (BIAL) can be construed as “Public Authority” and therefore it would be within the purview of the RTI Act. This issue arose out of an RTI application regarding suo motu disclosure by BIAL sought Benson Isaac, a citizen. While refusing to entertain Isaac's RTI application, BIAL took the stand that it was not a public authority as defined under the Act and as such was not under any obligation to make disclosures under RTI. I thought I'd begin my blog on Citizen Matters with the question: does the citizen really matter? Recent experiences in Bangalore suggest that they do not, especially in the context of public policy. The ongoing brouhaha over the Bangalore International Airport (BIAL) is only the latest example of the total lack of transparency and complete disregard for citizens' rights to information and self-determination that mark planning (if any) for the city's development.
