Bruhat Bengaluru Mahanagara Palike (BBMP) Commissioner Manjunath Prasad has said that properties in 110 villages added to BBMP in 2007, which are on B-Khatha list, will be regularised. These properties will be de-linked from the Akrama-Sakrama scheme, on which a public interest litigation is going on in the Supreme Court. It is not clear how many properties will benefit from this, and whether it will be vacant sites alone, or if it will include the built up properties as well. The Akrama Sakrama scheme, which seeks to regularise unauthorized constructions and developments, has been one of the most contentious civic issues in Bengaluru. The scheme was initiated by the Karnataka Town and Country Planning Act and Certain Other Laws (Amendment) Act, 2004. This Act amended the Karnataka Town and Country Planning Act, 1961, the Karnataka Municipal Corporations Act, 1976 and the Karnataka Municipalities Act, 1964.   After this amendment was stayed by the Karnataka High Court in 2007,  having been found to be prima facie against constructional provisions, the state extended the scheme by passing amendments in 2009 and 2013.…

With the last date for receiving applications under Akrama Sakrama scheme having come to an end, the BBMP has received a lacklustre response from people willing to apply under the scheme. The number of applicants in entire BBMP limits is as low as 37, as on the last day - March 22nd, 2016. The State government introduced Akrama Sakrama scheme last year and gave a time frame of one year from March 23rd, 2015 to March 22nd, 2016, for people to apply seeking regularisation of unauthorised buildings. Even as the State government is gearing up to implement the Akrama Sakrama scheme that allows the regularisation of the building byelaw and certain land use violation in urban areas including Bengaluru, the new rules have raised several concerns. While a section of the civic society opposes the concept of regularisation as a whole, a few others find lacunae in the new rules which they say might prove disastrous if the scheme is implemented. Every day there are illegal constructions coming up in various places in Bengaluru. Are the authorities blind? Can't they see these as they drive past them? Why is this going on even when laws strictly prohibit them? While illegal constructions should in most cases be demolished, there would be important considerations.
